On July 31st, 2019, BBB received a response from Summit Contracting regarding the pattern of complaints:

In regards to the pattern of complaints that Summit Contracting Inc. has had in the recent months, we have been working tirelessly to ensure each one of our customers concerns and/or complaints were addressed and handled in a timely manner. Many of the issues were with ordering times, and install dates. At this time, all but two of our customers are completely finished and satisfied. Two of our customers, ***** and *****, will be completed within the next two weeks. Discounts were issued if necessary, and communication has been kept up with all customers. To our knowledge, we do not have one single existing  complaint from any of the customers listed, and will continue to work with our new customers to make sure they receive the best service possible. To ensure this, we have hired the appropriate trained, professional staff for ordering purposes, as well as implemented production managers to be in charge of the end product. We have also increased staff in our customer service department to take calls and be in daily communication with customers. We look forward to serving many more customers, and maintaining a high rating with the BBB. 

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

The United States has filed a complaint seeking a civil injunction against De Pere business Summit Contracting, Inc., and owners Chad Schampers and Nathaniel Smith.

The complaint was filed based on alleged wire fraud and banking law violations, according to the United States Attorney of the Eastern District of Wisconsin.

The purpose of the injunction is to "prevent a continuing and substantial injury to the victims of fraud."

On February 5, 2020, Summit Contracting, Chad Schampers and Nathaniel Smith entered into a Consent Decree and Final Judgment without any admission or finding of liability or wrongdoing and have agreed to the Consent Decree and Final Judgement to avoid the delay, uncertainty, inconvenience and expense of protracted litigation.  

It is hereby ordered, adjudged and decreed that:

PROHIBITIONS

A. The Settling Defendants, and their agents, officers, and employees, and all persons in active concert or participation with them, are permanently enjoined from:

i. Making any false statement, or acting under false pretenses with respect to, any financial institution (or any agent or intermediary of any financial institution) with respect to any financing transaction;

ii. Misrepresenting or failing to fully and accurately disclose to prospective or actual Summit customers the terms of financing offered for Summit projects;

iii. Requiring Summit customers to sign paperwork or electronic documents concerning the completion of work before Summit has confirmed completion of the work with the customers;

iv. Threatening or intimidating any customer or former customer of Summit who posts a negative review online or in any other medium or provides information in connection with any law enforcement investigation of the Settling Defendants’ misconduct; and/or

v. Destroying, deleting, removing, or transferring any and all business, financial, accounting and other records concerning the Settling Defendants’ operations.
