On Nov. 28, 2018 Jamie Smith was charge with multiple counts of Fraud and multiple counts of Wire Fraud. It has been alleged that, through his work at APGS and AIGS, Mr. Smith contacted individuals concerning their coins and precious metals, and offered to appraise the coins, or buy them, or trade, or sell them for the client. Mr. Smith would send prepaid FedEx boxes to the clients to use to ship the coins to Mr. Smith. He sent APGS or AIGS invoices, by mail or email, to the clients detailing the nature of the coin transaction and the current price or value of the coins in question. During the period beginning in or about May 2010 and continuing to on or about February 25, 2017 in the Western District of Wisconsin and elsewhere, Mr. Smith knowingly and with the intent to defraud, devised and participated in a scheme to defraud the clients of APGS and AIGS, and to obtain money and property by means of materially false and fraudulent pretenses, representations, promises and by concealment of the material facts.
On March 4, 2019, the court held a telephonic hearing on the government's motion to supplement defendant's conditions of pretrial release. The court, the parties, and the pretrial services office reached a consensus on the new conditions: defendant shall post on all of his business websites notice of the indictment returned against him in this case. Defendant promptly shall provide to pretrial services copies of all the invoices and written quotes he has issued to current and prospective clients so that pretrial services can confirm that defendant has provided notice of this prosecution. Defendant shall not close any deals orally. Defendant shall not contact or communicate with the witnesses identified by the government in its motion, although he may continue to makes payments pursuant to any pre-existing agreements.
On September 17, 2019, Jamie Smith plead guilty, sentencing is scheduled for December 11, 2019.
