BBB requested if every product sold at the store is 50-70% off and what the 50-70% was taken off of, retail price or manufacturer suggested retail price.

“We guarantee to have the lowest prices "piece for piece" whether it's an adjustable base you are searching for or maybe a sofa with power headrest and reclining. We guarantee the lowest prices not just here in The North Country but in all 50 States!”

“We guarantee the lowest prices around on Home Furnishing and Mattress.”

BBB advised the business that their lowest price guarantee states that they guarantee the lowest prices in all 50 states, but on the page that provides terms and conditions of the lowest price guarantee, it states that the price has to be from a competitor with a brick and mortar store within a 50 mile radius. If this is the case, the statement must be modified to reflect that.

“We are Northern New York's #1 Recommended Furniture Store, so come in today and check us out!”

BBB requested documentation from a neutral third party providing results of a survey, for example, to prove that the business is “Northern New York’s #1 Recommended Furniture Store”

BBB advised that this contradicts the lowest price guarantee that appears on the “about” page and requested that they update one or the other to ensure all advertised policies are consistent throughout the website.

BBB requested substantiation of the claim that their business is the largest showroom in the North Country for Flexsteel and Lane Furniture.

The website includes CBD product claims on multiple pages. The FDA has not approved any over-the-counter (OTC) drugs containing CBD, and none of these products meet the requirements to be legally marketed without an approved new drug application.

BBB Code of Advertising Principle #1. Basic Principles of the Code

1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.

BBB Code of Advertising Principle #12. Lowest prices, underselling claims
Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of unqualified underselling/lowest price claims.
12.1 Advertisers must have proper substantiation for all claims prior to dissemination.
12.2 Unqualified underselling claims must be avoided.
12.3 Advertisers can lessen the potential for consumer confusion by appropriate qualifications to any underselling/lowest price claim, such as by stating, if truthful, that the advertiser will meet or beat a lower price. In such circumstances, the advertiser must comply with Section 13.

BBB Code of Advertising Principle #13. Price equaling, meeting competitors’ prices
13.1 Advertisements which set out company policy of matching or bettering competitors' prices may be used, provided that:
13.1.1 The offer is made in good faith;
13.1.2 The offer clearly and conspicuously discloses fully any material and significant conditions which apply including, if applicable, what evidence a consumer must present to take advantage of the offer; and
13.1.3 The terms of the offer are not unrealistic or unreasonable for the consumer.
13.2 Advertisers should be aware that such claims, unless appropriately qualified, may create an implicit obligation to adjust prices generally for specific products or services. This may be the case where the advertiser's price for a product or service is not as low as or lower than a competitor's price.
