  BBB sent correspondence to Obsidian Herbal Health on May 26, June 26, July 27, and August 15, 2022, requesting substantiation or modification for advertised claims on the website, https://www.blackseedoilgummies.com/, twitter page, https://twitter.com/OhhGgummies, Facebook page https://www.facebook.com/Blackseedoilgummies, and Instagram page, https://www.instagram.com/blackseedoilgummies/, and a blog featured on this site, https://webuyblack.com/blog/stay-safe-this-winter-with-obsidian-herbal-healths-black-seed-oil-gummies/ as well as blogs on the website blog page. 
  
  BBB has noted medicinal and therapeutic claims are being made for Black Seed Oil and Elderberries. BBB has also noted the numerous links provided to support claims, however, more clinical research is required, and the claims that are being made would classify the product as a new drug that is not approved by the FDA. The research cited on the website involves studies done in vitro, on animals, and/or state that more research is necessary so this evidence does not substantiate the claims made.
  
  To follow are some examples of claims in the advertising:
  
  “Thymoquinone is a phytochemical compound, it is the most active and abundant antioxidant constituent present in black seed. Research shows that it has promising pharmacological properties against several diseases. It exhibits amazing antioxidants, anti-inflammatory, anticancer, and other major biological activities. Basically, it scavenges free radicals and prevents the cell damage resulting from oxidative substances.”
  
  “Black seed (Nigella sativa L) is indeed a wondrous herb and has over 6000 scientific and clinical research studies published in major health and research journals. Click on the illnesses below to check out the scientific research regarding it below.
  Allergies,  Anemia,  Antibiotic,  Anti-inflammatory,   Antioxidant,   Anti-viral,  Asthma,  Cancer Research,  Cardiovascular support,   Cognition,   Covid,   Diabetes,   Hypertension,  Immune system support, Joint support,   Respiratory Support,   Rheumatoid Arthritis,   Weight loss/Obesity”
  
  “Elderberries are also well known for reducing inflammation and oxidative stress."

  BBB’s Code of Advertising #34 Claimed Results states:
  Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. 
  
  Similar medicinal claims appear in testimonials.
  BBB’s Code of Advertising #30. Testimonials and Endorsements states
  30.1 In general, advertising which uses testimonials or endorsements is likely to mislead or confuse if:
  30.1.3 It contains representations or statements which would be misleading if made directly by the advertiser;
  In the U.S., advertisers should consult the Federal Trade Commission Guides on Testimonials and Endorsements for detailed guidance. In Canada, advertisers should review the Competition Bureau’s publication on Untrue, Misleading or Unauthorized Use of Tests and Testimonials for specific guidance.
  
  The advertising also states that ingredients are “certified organic”. BBB requested proof of organic certification.
  
  The business has responded stating that updates would be made to their advertising, but to date, none have been made.
