The sale of Delta 8 products and/or smokeables is illegal in New York State.
BBB's Code of Advertising #34 Claimed Results states,
"Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data."
The business is making medicinal and therapeutic claims for CBD products which is illegal per NYS Senate Bill S854A § 86. Adult-use cannabis advertising and marketing.
To date, the FDA has not approved a marketing application for cannabis for the treatment of any disease or condition.
As of today, the business has not responded to our request and their advertising has not been modified.
