Asylum and Withholding of Removal

Asylum and withholding of removal are two forms of relief available to many migrants present in the U.S. without status or those arriving at the border. Asylum is an option for those who have been persecuted based on their (1) race, (2) religion, (3) nationality, (4) political opinion, or (5) membership in a particular social group. Our attorney handles every asylum and withholding of removal case with great care, knowing that unpacking trauma — while necessary for an asylum claim — can be extremely difficult. We will work with you to make this process as seamless as possible.

Consular Processing
If you or a family member is outside of the U.S. and wants to apply for a green card, you will follow the process of consular processing. We can help you prepare and submit the necessary applications and help you prepare for your interview with the Department of State’s National Visa Center (NVC).

Family Petitions
For those inside the U.S. who are married or related to U.S. citizens and Legal Permanent Residents, there is a path of adjustment available through the Form I-130. Spouses are immediately eligible to apply for adjustment of status after their bona fide marriage to a U.S. citizen or Legal Permanent Resident as long as they are not barred by any grounds of inadmissibility. Other family members of U.S. citizens may also be eligible for adjustment of status, including parents, siblings, and children. If you are not yet married and want your future spouse to join you in the U.S., a fiancé visa may be available to you. Naturalization

Removal Defense
If you or a loved one have been detained at the border or within the U.S., you may be at risk of deportation (removal). For many who have been detained and now face removal, hearings before an immigration judge will be a required step in the removal process.
