    February 27, 2019 The following describes a Cease and Desist that has been formally brought by a government agency. Office of Attorney General Maura Healey, alleges and charges as follows:

    Attorney General Maura Healey sent a cease and desist demand letter to Kilo E-Liquids (Kilo), an online retailer of electronic cigarette devices, ordering the company to stop sales to Massachusetts residents after an investigation revealed it violated Massachusetts laws regulating the sale and advertisement of tobacco products.

    The demand letter, orders California-based Kilo to stop selling their products online in Massachusetts until the company can demonstrate they are in full compliance with state laws. The letter also prohibits the company from advertising vaping products on all websites directed at youth.

    "E-cigarette companies have taken a page out of the playbook of the tobacco companies to get young people addicted to their products," said AG Healey. "If these retailers are operating in our state, they must comply with Massachusetts laws and keep their products away from children."

    The AG's Office's began investigating Kilo after receiving a complaint about an advertisement for Kilo's vaping products on an educational website frequented by K-12 students, teachers, and schools. Investigators also determined that Kilo does not adequately verify the age of customers purchasing vaping products, which include flavored nicotine e-liquids such as "green apple candy" and "strawberry milk," from its website.

    Massachusetts law and regulations set the minimum legal age to purchase electronic smoking devices at 21, and imposes two requirements on online retailers of these products to verify a purchaser's age: use a commercially available database to verify the age and identity of purchasers; and use a method of mailing, shipping, or delivery that requires the signature of a person who is of the minimum legal age before the package is released.

    On April 24, 2019, BBB Serving Los Angeles and Silicon Valley requested that the business substantiate, modify, or discontinue claims on the company's website, www.kiloeliquids.com. The company advertises "Manufactured in a Certified Facility" and "Made in the U.S.A."

    The BBB Code of Advertising states that, "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB."

    The BBB Code of Advertising also states, "37.1 "Made in USA" and similar terms used to describe the origin of a product must be truthful and substantiated. 37.2 An advertiser must not express or imply that a product or product line is exclusively "Made in USA" unless all or virtually all of the product is made in the U.S. All significant parts and processing that go into the product must be of U.S. origin. That is, the product should contain no -- or negligible -- foreign content. 37.3 Advertisers can refer to products that are manufactured with foreign components as "Assembled in USA," if the product's principal assembly and last substantial transformation was completed in the U.S. 37.4 Qualified "Made in USA" claims, for example, "60% U.S. content," "Made in U.S. of U.S. and imported parts," are appropriate for products that are manufactured or have been substantially assembled domestically. However, advertisers must avoid making these claims if a significant amount of assembly or material of the product was not completed in the U.S. Qualified "Made in USA" claims, like unqualified claims, must be truthful and substantiated."
