On July 16, 2024, BBB Serving Los Angeles andSilicon Valley requested that the business substantiate, modify, or discontinueclaims on the company's website, https://store.kinnls.com/.BBB requested that the business clarify their relationship with the organizationsadvertised on their website (Cision,Morningstar, Markets Insider, and Yahoo!). BBB alsorequested that the business substantiate, modify, or discontinue Comparative Price, Value and Savings Claims.
The BBB Code of Advertising states, “1.1 The primary responsibility fortruthful and non-deceptive advertising rests with the advertiser. Advertisersshould be prepared to substantiate any objective claims or offers made beforepublication or broadcast. Upon request, they should present such substantiationpromptly to the advertising medium or BBB. 21.1 The composition and layout ofadvertisements should be such as to minimize the possibility ofmisunderstanding by the reader. 21.1.1 For example, prices, illustrations ordescriptions must not be so placed or displayed in an advertisement as to givethe impression that the price or terms of featured products or services applyto other products or services in the advertisement, when such is not the case.”The BBB Code of Advertising also states, "BBBrecognizes that truthful price information helps consumers make informedpurchasing decisions and that comparative price advertising1 plays an importantrole in promoting vigorous competition among retailers. At the same time,misleading or unsubstantiated pricing claims injure both consumers andcompetitors. The following examples offer guidance on ensuring that pricingclaims are truthful and not misleading. 2.1 Advertisers may offer a pricereduction or savings by comparing their selling price with: 2.1.1 Their ownformer selling price; 2.1.2 The current selling price of identical products orservices sold by others in the trade area (the area in which the company doesbusiness or where the advertisement appears) (e.g., "selling elsewhere at$_______."); or 2.1.3 The current selling price of a comparable product orservice sold by the advertiser or by others in the trade area (e.g.,"comparable value," "compares with products or services sellingat $_____," "equal to products or services selling for $_____").2.2 In each case, the advertisement must clearly and conspicuously disclosewhich basis of comparison is being used. 2.3 When these comparisons are made inadvertising, the claims must be based on the provisions in Sections 3 - 7."
