The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.
On August 3, 2018 West Virginia Attorney General Patrick Morrisey filed a lawsuit with Kanawha County Circuit Court against New River Firewood and Power Trust Equipment. The lawsuit accuses the companies and senior management of unfair and deceptive business practices and violating consumer protection laws. The lawsuit alleges New River Firewood and Power Trust Equipment deceived consumers that purchased gas-powered log splitters made by Power Trust Equipment. Consumers allege the splitters curled, broke wedges and blew hydraulic hose fittings due to defective materials, including clamps, and inadequate welding, all posing a high risk of physical injury. In the lawsuit, the Attorney General seeks full restitution for the affected customers, a $5,000 penalty for each violation of the state's Consumer Credit and Protection Act, and full reimbursement to cover the costs associated with the state's investigation and litigation.
