Full One-Year Warranty on Swimming
Pool and Spa Installation: 
If failures or
defects occur to swimming pools or spas (aka hot tubs) or included equipment
that is not due to any of the warranty exclusions during the first year after
certificate of completion signature date, the swimming pool or spa will be
repaired free of charge. Additionally, most swimming pool and spa products and
materials have extended manufacturer warranties. If failure or defect is solely
due to a swimming pool or spa product defect and product is covered by a
manufacturer warranty, then delivery, installation labor, and any additional
material costs required to install replacement and/or perform repair will be
paid by product owner.

 

30-Day Limited Plant & Sod
Warranty: 
All trees,
plants, and lawns are guaranteed to be alive at time of installation. If living
material fails to thrive (e.g., trees, plants, and sod) and it is not due to
any of the warranty exclusions during the first 30 days after certificate of
completion signature date, the living material will be replaced free of charge
one time. Additionally, some living materials have 1-year supplier warranty.
After 30 days, if living matter fails to thrive and product is covered by a
supplier warranty, then delivery, installation labor and any additional
materials required to install replacement will be paid by product owner.

 

Limited One-Year Warranty on
Irrigation Systems and Hardscape Products and Installation:  If failures or defects occur to irrigation
systems or hardscapes that is not due to any of the warranty exclusions during
the first year after certificate of completion signature date, the irrigation
system or hardscape item will be repaired and/or replaced free of charge one
time.  Hardscape materials included under
this warranty consist of:  retaining
walls, pavers, blocks, fire products, water features, outdoor kitchen
equipment, and landscape lighting. Concrete patios and pool decks are excluded
from warranty. Additionally, some hardscape materials have extended
manufacturer warranties. If failure or defect is solely due to a product defect
and product is covered by a manufacturer warranty, then delivery, installation
labor, and any additional material costs required to install replacement and/or
perform repair will be paid by product owner.

 

Warranty Exclusions:  This warranty does not apply to
installation or product failures or defects after installation of swimming
pools, spas, living matter, irrigation systems, materials, or hardscape
products if any of the following occurs: 
manufacturer or supplier product defects; variations or deficiencies in
sprinkler or irrigation systems functionality caused by water volume, pressure,
or sediment; water discoloration or disfigurement; erosion or settlement;
damage created by lack of rain gutters; abuse or vandalism; acts of nature or
adverse weather conditions (including wind, heat, or freeze damage); acts of
God; vehicular or pedestrian traffic; owner’s negligence or misuse; not
cleaning emitters and sprinkler heads of debris on a regular basis; acts of
other persons or external entities not controlled by the company; or work done
by others.  Work done by others consists
of other persons or property owners: 
making changes to items installed by our company; performing work on top
of or adjacent to items installed by our company (e.g., such as installation by
others of:  foundations, electrical,
plumbing, concrete, asphalt, paint or chemical sprays, stucco, fences, decks, irrigation
systems, concrete overlay, or any other items installed by other contractors or
homeowners); and/or performing improper or incorrect maintenance or repair.
Improper or incorrectly performed maintenance, service, or repair immediately
voids this warranty.  If failure or defect
is due to any of the warranty exclusions and repair and/or replacement is
requested, then delivery, installation labor, and all material costs required
to purchase and install replacement and/or perform repair will be billed
separately and paid by product owner.

 

Warranty Service:  This warranty is transferable to
others upon change of ownership as long as it is within the warranty
period.  Change orders will only be
covered by this warranty, if agreed-upon, authorized by both parties and documented
in writing.  All verbal change orders
will not be covered under this warranty. To obtain service under this warranty,
the property owner must contact the company by either email, mail, or calling
the number listed on this contract.  The
company will inspect the owner’s premises within ten (10) days of such
notification at a mutually agreeable time, and if it is determined that
warranty service is necessary and meets the specifications in this warranty,
the company will perform such service at an agreed upon time.  Amount of repairs cannot exceed the original
cost of the line item included on this contract. Repairs required in accordance
with this warranty must be completed by our company or a company directly
contracted by us or our company is not responsible for costs. The company is
not liable for any consequential or incidental damages other than damages
expressly imposed by law arising out of the failure of any part of the warranty
work done and/or the defects of the products and/or materials installed. No
informal dispute settlement mechanism exists to resolve disputes which may
arise under this warranty. The company may, by its sole discretion, modify
these terms and conditions at any time as it may deem necessary. If a lien,
litigation, or collection process is required to obtain payment then all expressed
or implied warranties will be immediately cancelled.
