The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On May 17, 2018, the State of Washington King County Superior Court filed a complaint for injunctive and other relief under The Consumer Protection Act, RCW 19.86 against defendants Real Estate Investment Network, LLC (REIN); Kerry Hemmingsen; Daniel Stack; William Gastineau.
REIN is an Oregon LLC company with its principal place of business located in Portland, Oregon and maintains business addresses in Washington. REIN is not registered to do business in the State of Washington.
It is alleged the defendants targeted consumers under severe financial and emotional distress. It is also alleged defendants targeted elderly consumers.
It is alleged the defendants violated The Consumer Protection Act for unfair and deceptive acts and practices used by defendants to convince consumers with recently foreclosed property to enter into unconscionable agreements that convey the consumer's ownership interest in said property, including rights to surplus funds, to Real Estate Investment Network, LLC in exchange for a small fraction of the amounts they are entitled to under law.
The court is seeking civil penalties of up to $2,000 per violation against defendants for each and every violation alleged and the court recover from defendants the costs of this action including reasonable attorney's fees.
