The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.On September 30th, 2021 the business has not participated in this adjudicative proceeding from the Division of Consumer Protection by failing to file a request for a hearing, after having been duly served with the Citation in this matter. Where Respondents have failed to timely contest and request a review of the Citation initiated by the Division of Consumer Protection the Citation becomes the final order. The Assurance settles allegations that the business knowingly or intentionally receiving a deposit from the consumer but failed to provide the products and services that the consumer purchased from them within the time frame represented, accepted a deposit from the consumer, and after receiving a valid request for refund from the consumer, failed to provide the consumer with a refund within 30 days of the consumer's valid request, and attempted to induce the consumer into making additional payments to Respondents by telling the consumer that Fintek was a third-party, and that Fintek was unwilling to allow the consumer out of the consumer's financing agreement. Respondents had full control of Fintek, and could have cancelled the agreement instead of threatening legal action to enforce the agreement.Under terms of the Assurance, the business agreed to pay an administrative fine in the amount of $7,500.00. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
