- Additional Info:BBB initiated an investigation on this business by corresponding with them on July 27, 2016 following a review of the business' contract submitted for BBB's evaluation.
BBB noted the following items would need to be changed, per BBB Houston's policy and Texas law: (1) A 3 day cancellation policy should be added that states no cancellation fee will be incurred during that time period, as required by Texas law. BBB consulted Texas law, which states, from the Texas Business and Commerce Code: "SUBCHAPTER B. CONSUMER'S RIGHT TO CANCEL TRANSACTION, Sec. 601.051. CONSUMER'S RIGHT TO CANCEL. In addition to any other rights or remedies available, a consumer may cancel a consumer transaction not later than midnight of the third business day after the date the consumer signs an agreement or offer to purchase." The contract initially stated a fee could occur even if a client cancels before 3 days. Though the business added a 3 day notice, additional stipulations were included stating a consumer will not receive a refund if items were already delivered or emergency work is performed, even if they cancel within 3 days. BBB asked that these stipulations be removed as they are not permitted, per the law, and the business stated on July 27, 2016 it would not remove the stipulations, though required by Texas law.
