- Advertising Review:On February 17, 2016, BBB contacted Garcinia Cambogia Ultra regarding advertised claims on its website, http://www.garciniacambogiaultra.com. Specifically, BBB requested the business substantiate claims regarding weight loss and health benefits of Garcinia Cambogia Ultra, including claims that Gacrcinia Cambogia “stimulates the production of serotonin levels in the brain, elevating mood and promoting wellbeing,” “has the ability to balance blood sugar levels by delaying the absorption of glucose in the intestines,” “improves the ability of the liver and skeletal muscle to store glycogen,” and “aids digestive and heart health.” BBB Code of Advertising states claims relating to performance, energy savings, safety, efficacy, or results for a product or service should be based on recent and competent testing or other objective data.
BBB also requested the business provide material limitations or conditions that apply to the advertised “no risk guarantee” and “100% satisfaction guarantee” clearly and conspicuously. BBB Code of Advertising states when “money back guarantees” or similar representations are used in advertising, any material limitations or conditions that apply to the guarantee must be clearly and conspicuously disclosed.
Additionally, BBB has been contacted by consumers who allege they are charged with reoccurring charges to which they did not agree after ordering weight loss supplements, and are charged for supplements after canceling within the trial period offer. BBB was unable to find the existence of a negative option feature disclosed on the website, and asked the business clarify how consumers are informed of reoccurring charges during the checkout process. BBB further requested the business provide substantiation showing how consumers consent to future charges. BBB Code of Advertising states any advertisement for a product or service that includes an offer to sell or provide consumers with additional goods or services under a negative option feature must include a clear and conspicuous disclosure of all material terms of the negative option feature. Such material terms include: the existence of the negative option feature; the cost of the additional goods or services; how consumers can cancel and avoid future shipments and charges’ and how consumers can return items that they do not want. Advertisers must avoid making disclosures that are vague and must not interpret the consumer’s silence, failure to take an affirmative action to reject goods or services, or failure to cancel the agreement, as consent to enroll the consumer in the negative option. Instead, they must ensure that the consumer affirmatively consents to the negative option feature before enrolling the consumer in the plan.
BBB also requested the business clarify whether or not the advertised endorsers, Dr. Marc Weis, MD, Dr. Daniel Alterman, MD, and Dr. Melissa Milan MD, MS, received payment for reviewing Garcinia Cambogia Ultra or if these endorsers have any financial interest in the company. Additionally, BBB requested the business provide the “clinical data” and “supporting scientific studies” referenced in the endorsements regarding the efficacy and safety of the product. BBB is aware of similarly worded reviews, purportedly from the same endorsers regarding the products “YeastClear” and “AnxiClear” found at https://www.yeastclear.com/doctor_formulated.html, http://www.anxiclear.com/doctor_formulated.html. BBB requested the business clarify in their response if it owns or operates YeastClear and AnxiClear.
Finally, BBB requested the business substantiate or modify the advertised claim that the product “contains more HCA (60%) than any other product on the market.” BBB Code of Advertising states advertisers must not deceptively or falsely disparage a competitor or competing products or services in their advertising. Truthful comparisons using factual information may help consumers make informed decisions, provided all representations are consistent with the general rules and prohibitions against false and deceptive advertising and the advertiser can substantiate all claims made. As of March 16, 2016, BBB did not receive response from Garcinia Cambogia Ultra regarding these requests. As of February 17, 2019 the business continues to advertise the claims.
