STATE OF TEXAS (ACTING BY AND THROUGH THE ATTORNEY GENERAL OF TEXAS vs. HERNANDEZ, SERGIO (INDIVIDUALLY AND DBA SOUTHWEST FORKLIFT)
On July 12, 2023 the State of Texas in the District Court of the 269th Judicial District in Harris County granted the State's motion for default judgement against the defendant and rendered final judgement for the plaintiff, the State of Texas. This determination settles allegations that the business posed potential employers and posted phony job opportunities in order to induce consumers to purchase the company’s training. Under terms of this judgement, the business cannot advertise job postings that do not exist. Pattern of Complaints
Since 2015, the Better Business Bureau of Greater Houston and South Texas has received complaints and customer reviews indicating a pattern.
Complainants stated they pay approximately $100 to become certified forklift operators and are often promised this will lead to a job. After attending a video session for training and taking a test, participants are given a card purporting to confirm their certification as a forklift operator. However, complainants to the BBB later learn this certification is not legitimate, despite claims, and when they inquire about job opportunities to the business, they do not receive a response and are not able to receive refunds.
