BBB sent Letters of Inquiry to the business via mail and e-mail regarding their Energy Conservation Program. The business responded to BBB by stating the business is not associated with any government programs.  The Energy Efficiency Program being promoted is a system of products that entitles homeowners to rebates and incentives through either the federal government or local utilities.  The business states they have auditors on staff that are BPI certified

BBB contacted the City of Baton Rouge April 14, 2014 regarding their Weatherization Project which is part of the State of Louisiana and a nationwide Energy Conversation Program. BBB has spoken to the Director of the Weatherization Program with the Office of Community Development, which has stated home audits provided through this project are conducted by City employees and do not currently contract with outside businesses. 

Government Actions

State of Texas vs E-Grid Tech LLC, f/k/a EnviSmart LLC, and d/b/a EnviSolar, d/b/a EnviroSolar, d/b/a Next Step Energy, d/b/a KMA Investments, and d/b/a KMA, and Abraham "Abe" Issa Individually

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On July 25, 2018, Abraham "Abe" Issa individually entered in an Assurance of Voluntary Compliance with the Texas Attorney General. The Assurance settles allegations that  violated the Home Solicitation Act and the Texas Deceptive Trade Practice - Consumer Protection Act based on certain alleged acts, including, but not limited to deceptive, misleading and/or confusing sales practices, misrepresentations of products, failure to provide required notices of cancellation rights and failure to provide required cancellation forms.

Under the terms of the Assurance, the business agreed to the following terms:

• Provide each consumer with a complete copy of their executed sales contract and any other marketing materials describing the qualities or quantities of goods or services offered or sold during the door-to-door sales calls or transaction
• Attach the three-day cancellation notice to the consumer's executed sales contract during a door-to-door sales transaction 
• Provide each consumer a paper copy of the contract signature page, including the notice required by Tex. Bus. & Com. Code Sec 601.052(b)(4)(B) in no less than 12-point all caps bold faced font and a paper copy, in duplicate, of the completed cancellation form otherwise required by Tex. Bus. & Com. Code Section 601.053(a)(3) in no less than 12-point all caps bold faced font
• In the offer or sale of goods or services within the State of Texas, performing any door-to-door sales or promotions without:
  
  • before entering a consumer's residence, clearly and conspicuously disclosing, in writing on a document provided to the consumer in at least 12-point all caps bold faced font, the identity of the sales representative and the consumer's right to order the sales representatives to immediately leave the consumer's residence at any time, for any reason, under any circumstances
  • before sales representative enters a consumer's residence, performing a background check on the sales representative
  • providing a consumer with a copy of their executed sales contract as required by the Home Solicitation Act
  • providing each consumer, at the time the sales agreement is executed, a single page "Purchase Summary" hard paper document including one column itemizing each of the products/services purchased by the consumer and a row listing the consumer's total purchase price (including tax) with an original signature by the consumer and the sales representative, along with both a statement of the consumer's right to cancel and an additional copy of the Notice of Cancellation in the same form
  • including, in the consumer's executed sales contract, a statement giving notice of of the consumer's right to cancel 
  • attaching a copy of the completed notice to cancellation to the consumer's sales contract
  • verbally informing a consumer at the time of sale a consumer's right to cancel
  • providing each consumer who is 65 or older a copy of their sales contract and a copy of the completed "Notice of Cancellation" mailed within two business days of the consumer's execution of such contract
  • financing arranging for financing, transferring or negotiating a consumer's debt for the purchase of goods or services with Bridge Loan Financing only for a consumer younger than 65 years old
  • refrain from knowingly purchasing a Texas consumer's email, telephone, name or address information as a customer lead, from a third-party that E-Grid Tech, LLC know obtained such Texas consumer's information based on a materially false, misleading or deceptive misrepresentation of prices, tax credits, or available rebates or discounts for purchases of home energy efficiency products or services
• Refrain from representing that a good or service has characteristics, uses, benefits, or quantities which it does not have
• Refrain from representing that the solar products or home energy efficiency products/services offered for sale, sold, installed or serviced have met certification or testing requirements of any regulatory authority or body, unless those representation are factual and are provided to the consumer in a clear and conspicuous documentary form
• Refrain from including a provision in any contract impairing a consumer's right to complaint
• Refrain from misrepresenting to a consumer that any agent or representative holds a license, in good standing, to practice law
• Refrain from misrepresenting the source, sponsorship, approval or certification of goods or services including by use of any person to perform work related to delivery, installation, service or maintenance of who does not possess the requisite license, permit, certification or other requirements
• Refrain from materially failing to notify, within 10 business days of execution of such consumer sales contract, any third-party finance company that financed the particular consumer's purchase of goods or services if that sales contract is void
• Refrain from materially failing to notify, within 10 business days of execution of such consumer sales contract, each consumer's sales contract for purchase of goods or services that is void for failure to comply with therms of the Texas Business and Commerce Code
• Comply with all requirement of Texas state, county, and local law related to the inspection, installation and services associated with the sale or delivery of solar products and other home energy efficiency products/services sold to Texas consumers
• Refrain from engaging in any trade or commerce in the State of Texas without first filing an assumed name certificate in the offices or offices of each county clerk required by the Texas Business and Commerce Code
• Refrain from engaging in any trade or commerce in the State of Texas without first providing correct license, registration and certification required by the Texas Department of Licensing and Regulation
• Refrain from failing to obtain the consumer's express informed consent before charging a consumer for any good or service
• Refrain from requesting a consumer to authorize any use of the consumer's likeness less than 45 days after the consumer has received full performance of all goods and service
• Refrain from using any consumer's personal likeness for an endorsement without consumer's prior Express Informed Consent
• Refrain from misrepresenting that the Plaintiff, or the Court, has approved of any contracts, advertisements or conduct

Additionally, Abraham "Abe" Issa individually agreed to make a voluntary payment of $733,035 for compensation and settlement of identifiable Eligible Consumer's claims and a payment of $50,000 for reimbursement of reasonable attorneys' fees and investigative costs.
