On May 1, 2020 Blue Bell Creameries LP agreed to plead guilty to charges it shipped contaminated products linked to a 2015 listeriosis outbreak in violation of the Food, Drug and Cosmetic Act. Blue Bell agreed to pay a criminal fine totaling $17.25 million and an additional $2.1 million to resolve civil False Claims Act allegations regarding ice cream products manufactured under insanitary conditions and sold to federal facilities.

We are providing a summary of the government's allegations, which have not yet been proven.On October 20, 2020, Paul Kruse was indicted in United States District Court for the Western District of Texas Austin Division for ordering his sales employees to pull products from shelves without disclosing the reason to customers. At the time relative to the Indictment Paul Kruse was the President and Chief Executive Officer of Blue Bell and worked at the company's Brenham headquarters before retiring in 2017.Furthermore, Mr. Kruse rejected sending out a press release drafted to customers and the general public regarding products testing positive for Listeria monocytogenes and the ongoing withdrawal of certain Blue Bell products.
