On January 6, 2021, the Arizona Attorney General’s Office entered into a Consent Judgment with Guardian Protection Services to resolve allegations concerning “early termination fee” provisions in Guardian’s contracts with Arizona customers. Under the terms of the settlement, Guardian will provide $227,558.33 in restitution to 603 Arizona customers for the amount over $500 that each paid as a fee to terminate their contracts early, and pay $200,000 in civil penalties. The settlement also allows Guardian to charge an early termination fee to Arizona residents who enter into contracts with Guardian on or after January 6, 2021, if the fee is clearly and conspicuously disclosed in the contract and the customer has initialed next to the disclosure.
The Consent Judgment further reflects Guardian’s denial of the allegations and the parties’ agreement that it was entered into for settlement purposes only and is not an admission of wrongdoing or finding that the law was violated.
