The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On June 23, 2023 the Pennsylvania Attorney General’s office filed a lawsuit against Garden Art of Pittsburgh, LLC and its CEO, Arthur Ford, Jr. for violating Pennsylvania’s Unfair Practices and Consumer Protection Law alleging abandoning projects after retaining thousands of dollars in consumer deposits and utilizing non-compliant contracts.
According to the lawsuit, multiple consumers have filed complaints in the last two years with the Bureau of Consumer Protection alleging that they paid Garden Art of Pittsburgh thousands of dollars in down payments for home improvement projects, like installing retaining walls, walkways, stairs, etc, but few services were performed or no work completed. It is further alleged that the business and its owner used contracts that failed to notify consumers of their 3-day right to cancel, making the contracts non-compliant with Pennsylvania law.
The Office of Attorney General’s lawsuit is seeking to permanently prevent Garden Art of Pittsburgh, LLC and Arthur Ford, Jr. from doing business as a home improvement contractor in Pennsylvania, as well as consumer restitution for those impacted, civil penalties, and costs.
