The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On April 11, 2019 the Pennsylvania Office of the Attorney General announced legal action taken against 35 home improvement contractors. One of those contractors who action was taken against was Richard Barone, DBA Barone Masonry and/or Barone Construction, and/or C&G Masonry/Concrete, and/or Barone Concrete, and/or C&G Waterproofing, and/or Barone Masonry/Concrete who allegedly violated the Consumers Protection Law and the Home Improvement Consumer Protection Act (HICPA).
The Bureau of Consumer Protection received consumer complaints regarding deceptive acts and practices made by the company that consumers entered into a contract for home improvement services and company failed to perform an of, or failed to complete, or poorly performed services within the contracts.
In connection with the home improvement contracts, it is alleged that Mr. Barone violated many sections of the Home Improvement Consumer Protection Act. The contract violations include but are not limited to, failure to have notice of home improvement contractor registration number, business address, starting and completion work dates, signature of owner, his agent, or other contracted party, work description, materials to be used and set specifications that can not be changed without written consent signed by owner and contractor, insurance coverage, 3 day right to cancel notice, and toll-free phone number of Bureau of Consumer Protection. Mr. Barone was described to constitute unfair business practices by demand of payment for home improvement before contracts were signed.
Barone reportedly violated the Consumer Protection Law by failing to have a registered Fictitious Name for his businesses. On July, 26 2017, his Home Improvement Consumer Protection Act registration number PA063911 was deactivated due to failure to provide information to the Commonwealth which required to be provided. It is alleged that Barone continued to enter into home improvement contracts after deactivation. It is presumed that Mr. Barone was using business cards advertising to consumers that he had a “PA License” which was misleading due to a registration number does not equal a license.
The action seeks civil penalties of $1000 for each and every violation of the Consumer Protection Law, $3000 for each violation of consumers 60 years of age or older, as well as, restitution for consumers who suffered losses as a result of the violations to the Consumer Protection Law and Home Improvement Consumers Protection Act. The suit is also requesting that Barone does not own or operate a home improvement business, advertise offering for sale or selling home improvement services in his or a fictitious name, or attempt to register as a home improvement contractor.
