It goes on to state that the company closed its offices and plan to give the BBB a forwarding address for future mail. The BBB has received no such forwarding address. The company's letter blames its problems on another company "Premier Benefits Club." Premier Benefits Club provided the BBB and consumers a post card which included the following statement: "We have learned that a marketing company by the name of Credit Now/Commercial Products has misrepresented our membership benefits. We have sent this notice to you to inform you that we have issued a Notice of Cease and Desist to this company for misrepresentation and for apparent violations of Federal FTC regulations relating to advance fee loans."
US Credit Builders/Commercial Products/Credit Now denies the allegations in the statement from Premier Benefits Club.
The following statement is provided by the BBB of Southeast Florida in its report on Capital First Benefits which also does business as Premier Benefits Club: "On January 9, 2003, Case W03CA007, the Federal Trade Commission filed a Temporary Restraining Order with Asset Freeze and Other Equitable Relief against defendants, Assail, Inc., its president, Kyle Kimoto, two of its officers, Cliff Dunn, and Mike Henriksen; Infinium, Inc., Market-Reps.com, their president Brian Schofield; Specialty Outsourcing Solutions, Inc., its officers Jay Lankford, and Lee Murphy; Summit Communications International, Inc. d/b/a Advantage Capital, and its president Matthew Ho; Capital First Benefits, Inc. and its president Ben Lee; and Premier One Benefits, Inc. and its president John Salanga for violations of Section 5(a) of the FTC Act, the Telemarketing Sales Rule and Section 521 of the Gramm-Leach-Bliley Act.
According to the FTC, defendants targeted consumers with poor credit records, offering credit cards that never materialize, while upselling various benefits packages through a computer-generated verification tape, by making deceptive representations and engaging in unfair billing practices; assisting and facilitating others in fraudulently inducing consumers to pay for goods or services, and requesting an advanced payment and obtaining bank account numbers from consumers by means of false, fictitious or fraudulent representations.
The court temporarily halted the defendants' operation, froze their assets and appointed a receiver to take over the corporate defendants. The Case is Pending.
