On October 22, 2024, The Better Business Bureau (BBB) contacted the business regarding multiple advertising concerns on its website.
According to BBB Code of Advertising, The primary responsibility for truthful and non-deceptive advertising lies with the advertiser, who must be prepared to substantiate any objective claims made before publication. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
The business is advertising “For more than 100 years, the Barker family has provided family entertainment at events in Ohio, Pennsylvania, Michigan and West Virginia.” The business registered with the Ohio Secretary of State on May 16, 2016. The BBB requested substantiation regarding their claim and the business has failed to respond.
According to Section 28. Objective Superlative Claims, Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved.
The business is advertising “Barker Family Entertainment continues to be the first choice that all churches come to year after year for their party needs! With state licensed bounces, fully insured equipment, and friendly staff, where else would you go for the perfect mix of quality and safety that is presented by our company?” The BBB requested substantiation regarding these claims and the business failed to respond.
Additionally, the business is advertising as being a “Premium Member, Bouncy Castle Network.” The BBB was unable to verify, requesting substantiation from the business and they failed to respond.
To date, the BBB has received one consumer complaint that was closed as unanswered. As of November 11, 2024 the business has not provided substantiation, discontinued the challenged claims, or modified language regarding these advertising concerns or provided a response to the unanswered complaint. The BBB will continue to monitor.
