The Federal Trade Commission sent warning letters to 39 funeral homes across the country after investigators conducted the agency’s first undercover phone sweep and discovered several violations of the Funeral Rule, including funeral homes that failed to provide accurate pricing information or failed to give out price information entirely.
The Funeral Rule gives consumers important rights when making funeral arrangements, including requiring that funeral homes must “tell persons who ask by telephone about the funeral provider’s offerings or prices any accurate information from [their] price lists…. and any other readily available information that reasonably answers the question[s].”The Federal Trade Commission (FTC) is accusing Gresser Funeral Home of violating the Funeral Rule by providing inconsistent pricing information over the phone.
FTC staff has obtained information that, in June 2023, during undercover calls placed by the FTC, Gresser Funeral Home did not provide accurate information over the telephone in response to questions about their offerings or pricings. In particular, Gresser Funeral Home:
• Failed to provide accurate information about your prices or services. Specifically, on two occasions, and they provided materially different prices for the same goods and services on each call.
The FTC urges prompt remedial action to make sure Gresser Funeral Home and its staff provide accurate information over the phone about its prices and offerings.
The FTC can impose up to $51,000.00 per violation for repeated offenses.
