• Advertising Review:

  In May 2022, BBB contacted Best Quiz Games regarding claims in its advertising.
  
  The following claims appear on its website:
  "Training can improve brain connectivity and strength"
  "Brain Stretching  Enables quicker learning and an improvement in brain connectivity." 
  "Train your brain! Keep your brain fresh and in shape."
  "Strengthen your Mind!"
  The BBB Code of Advertising states that the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast and, upon request, present such substantiation promptly to the advertising medium or the BBB. In addition, Ohio law states that it shall be a deceptive act or practice to make any representations, claims or assertions of fact, whether orally or in writing, which would cause a reasonable consumer to believe such statements are true, unless the advertiser possesses or relies upon a reasonable basis in fact such as factual, objective, quantifiable, clinical or scientific data or other competent and reliable evidence which substantiates such representations.  Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. BBB requested that the business provide any recent scientific or clinical studies that prove the claims regarding its product but did not receive a reply. 
  
  Its website also states "There are no commitment periods, cancellation fees or other hidden fees." However, the business states at its Terms page, "Recurring Billing. By starting your premium membership, you authorize the Company or its payment processor to indefinitely charge your payment method the membership fee in effect when you originally signed up and any other applicable charges, such as taxes or possible transaction fees."  
  Whenever an advertiser mentions a price in advertising, the existence of any unavoidable or extra charges must be clearly and conspicuously disclosed in immediate conjunction with the price. BBB requested that this disclosure be added but did not receive a reply.
  
  With regard to the 'no commitment periods" part of the above-referenced statement, any advertisement for a product or service that includes an offer to sell or provide consumers with additional goods or services under a negative option feature must include a clear and conspicuous disclosure of all material terms of the negative option feature including he existence of the negative option feature; the cost of the additional goods or services; how consumers can cancel and avoid future shipments and charges; and how consumers can return items that they do not want. BBB requested that the business add these disclosures to its advertising but did not receive a reply.
  
  Its website's Account Verification page includes the statement, "Why do we ask for your billing information? Because we can only provide our prizes to certain countries, we ask that you provide a valid credit card number NO CHARGES GUARANTEED. No charges will appear on your credit card statement unless you upgrade to a Premium Membership or make a purchase." BBB asked the business for information about its premium membership and to explain why it states on its Support Page that the reason a credit card is immediately charged is for 'verification purposes.' "When you signup we may charge a small amount (up to $5.00) from your card to verify it is operational and valid."
  According to the BBB Code of Advertising, if a business is offering a contest where prizes are awarded, the advertiser must publish clear, complete and concise rules and provide competent impartial judges to determine the winners. BBB suggested that the business add this information to its advertising and provide clarification for the reason a credit card is charged at sign-up but did not receive a reply.
