- Warranties and Exclusions: King Garden Designs (KGD) warrants that it will perform the services in a workmanlike manner and in accordance with thespecifications on the Estimate. KGD also warrants any shrubs and trees supplied by KGD to remain alive for a period of one year fromthe date of planting, provided that such warranty shall be void if the Customer fails to take reasonable care of the plants (including without limitationwatering, spraying, cultivating, and pruning). Annuals, perennials, and sod, as well as any transplanted materials will not be warranted and are soldAS-IS. Contractor shall not be liable for any damage caused by Acts of God (including, without limitation, extreme cold or drought, flooding, storms,etc.). KGD sole responsibility for any breach of these warranties shall be, at its discretion, to repair or replace, as applicable, the plant or workaffected; provided; however, that for any tree or shrub that requires replacement the Customer will be responsible for the cost of the labor to replantsuch tree or shrub. EXCEPT AS EXPRESSLY SET FORTH HEREIN, KGD HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS ANDWARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICES TO BE PERFORMED AND ANY MATERIALS ORGOODS TO BE PROVIDED HEREUNDER.
