On 04/22/2024 the Better Business Bureau reached out to the company related to advertising appearing on https://www.trinitybuildingsystems.com/ purporting the capacity to offer contracting services within the state of New Mexico in spite of not possessing licensing sufficient to perform contracting services within the state.
14.6.3.8(A)(1) NMAC "To act in the capacity of a contractor asdefined in Section 60-13-3 NMSA 1978, an entity must be issued a license."
60-13-3 NMSA1978 "Asused in the Construction Industries Licensing Act, "contractor":
A. means any person who undertakes, offers toundertake by bid or other means or purports to have
the capacity to undertake, by himself or throughothers, contracting. Contracting
includes constructing, altering, repairing,installing or demolishing any:
(1) road, highway, bridge, parking area or relatedproject;
(2) building, stadium or other structure;
(3) airport, subway or similar facility;
(4) park, trail, bridle path, athletic field, golfcourse or similar facility;
(5) dam, reservoir, canal, ditch or similar facility;
(6) sewerage or water treatment facility, powergenerating plant, pump station, natural gas
compressing station or similar facility;
(7) sewerage, water, gas or other pipeline;
(8) transmission line;
(9) radio, television or other tower;
(10) water, oil or other storage tank;
(11) shaft, tunnel or mining appurtenance;
(12) leveling or clearing land;
(13) excavating earth;
(14) air conditioning, conduit, heating or othersimilar mechanical works;
(15) electrical wiring, plumbing or plumbing fixture,consumers' gas piping, gas
appliances or water conditioners; or
(16) similar work, structures or installations whichare covered by applicable codes
adopted under the provisions of the ConstructionIndustries Licensing Act;
B. includes subcontractor and specialty contractor;
C. includes a construction manager who coordinatesand manages the building process; who is a
member of the construction team with the owner,architect, engineer and other consultants required for
the building project; and who utilizes his skill andknowledge of general contracting to develop
schedules, prepare project construction estimates,study labor conditions and advise concerning
Construction"

1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
1.2 Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used.
1.3 An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true.
1.4 Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact."As of 06/14/2024 the company has not responded to any of our inquiries nor discontinued advertising licensed services within the state of New Mexico.
