On 12/28/2023 the Better Business Bureau reached out to https://buychoicebrands.com/ by mail and email concerning claims made on https://buychoicebrands.com/.
The Better Business Bureau lodged a challenge against the claim "Made In USA" with No US state/territory of manufacture listed. The BBB has challenged this claim based on the BBB Code of Advertising Section 37.1 which “Made in USA” and similar terms used to describe the origin of a product must be truthful and substantiated. The company has not responded to our request for substantiating this product is "Made in USA", contrary to section 1.1 of the BBB Code of Advertising stating "The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB."
The Better Business Bureau lodged a challenge against the claim "Chemical Free". We are challenging this because we found Ingredients For Choice Skin Cream listed Dimethylaminoethanol Bitartrate". "Dimethylaminoethanol was included in the 2004 Organization for Economic Co-operation and Development (OECD) List of High Production Volume Chemicals." See https://www.ncbi.nlm.nih.gov/books/NBK562906/. The ingredient list also mentions Propylene Glycol. Propylene Glycol is an Organic Chemical per https://www.ncbi.nlm.nih.gov/mesh?Db=mesh&Cmd=DetailsSearch&Term=%22Propylene+Glycol%22%5BMeSH+Terms%5D. This is being challenged based on section 1 of The BBB Code of Advertising "Basic Principles of the Code", specifically 1.2, "Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used."
The Better Business Bureau challenged the statement "Cruelty Free", based on the BBB Code of Advertising 36.5.1 An advertiser’s unqualified use of environmental certifications and seals of approval may imply to consumers that the certificate or seal was awarded by an independent third party. If that certification or seal was not, in fact, awarded by an independent third party, the advertisement must clearly and conspicuously disclose that fact. "Cruelty Free" is conveyed using a seal that appears similar to comparable, authentic Cruelty Free seals, possibly giving the impression the company is certified Cruelty Free by a third party.
The BBB has challenged the claim "Tested For Purity" because according to Section 1.1 of the BBB code of Advertising "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB." Pinnacle Payments, LLC DBA buychoicebrands.com has failed to provide evidence this claim satiates section 34 of the BBB Code of Advertising, "Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. "
The Better Business Bureau has challenged "Choice products are made with premium ingredients that are processed at a certified facility to meet & exceed industry standards." Section 1.1 of the BBB code of Advertising "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. "
The Better Business Bureau has been unable to substantiate any of the aforementioned claims. Emails and letters sent through USPS have not been responding to and attempts to reach the company telephonically at the numbers listed on their website offer a recorded response "This number has not been set up to receive calls, please try your call again later."
