On May 20, 2019, BBB contacted the business regarding its website stating the following:

According to the BBB Code of Advertising, Credit

Whenever a specific credit term is advertised, it must actually be available to all consumers. The federal truth in Lending Act, as well as applicable state and provincial laws set requirements for clearly and conspicuously disclosing credit terms in the advertisement.

• 16.7 No credit rejected
•  16.7.1 The words "no credit rejected," "guaranteed financing," "all credit applications accepted," or words of similar import can imply that consumer credit will be extended to anyone regardless of the consumer's credit worthiness or financial ability to pay. They must only be used when all credit requests are approved.

In the BBB's experience, auto dealers who make these claims are often trying to convey to consumers that they will work with them to get financing. However, most financing for those with poor credit included higher finance charges and annual percentage rates and a much higher down payment. Hence, these claims, do not support the BBB Code of Advertising. 

Warranties

When using the term "warranty" in product advertising, the advertiser must clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to sale at the advertiser's location, viewed on the advertiser's website, or, in the case of mail or telephone order sales, made available free on written request.

• When advertising "lifetime" warranties or guarantees or similar representations, the advertisements must clearly and conspicuously disclose its intended meaning of the word "lifetime."

Objective Superlative Claims

Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like "#1 in new car sales," can be proved or disproved.

Lowest prices, underselling claims

Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of unqualified underselling/lowest price claims.

• Advertisers must have proper substantiation for all claims prior to dissemination.
• Unqualified underselling claims must be avoided.

Claiming "lowest prices" means that a business constantly monitors the prices of all their competitors and they adjust all of their prices regularly to ensure their prices are always lower.

Unfortunately, the business did not respond to BBB's request to substantiate/modify or remove the claims from their website.
