On November 1, 2018 the Attorney General Gurbir Grewal and Paul Rodriguez, Acting Director of the NJ Division of Consumer Affairs ( collectively Plaintiffs) and CRA Construction and Home Elevations LLC , CRA Site Lawn & Land Development Inc. and Christopher Aldarelli, Defendants, consented to the entry of the Final Consent Judgment and its provisions without trial or adjudication of any issue of fact or law and without an admission of any liability or wrongdoing.
Plaintiffs commenced this action on August 21, 2017 by filing a Complaint. The Aldarelli Defendents have answered the Complaint denying any and all wrongdoings alleged.
This Consent Judgment is entered into by the parties for settlement purposes only.
Per the terms of the Consent Judgment, the Aldarelli defendants shall not commence home improvements without obtaining all applicable state or local building and construction permits;
they shall complete the home improvements and home elevation on the date or time specified in the home improvement contract;
they shall give written notice to consumers of reason beyond the defendants control for any delay in the completion of the signed contracts;
they shall provide consumers will all inspection certificates after the home improvements are completed and before final payment is due;
they shall not impose unjustified cost increases;
they will include home improvement contractors registration numbers on all contracts as required by the Registration Act;
The defendant shall include the toll-free telephone number provided by the Director of the Division of Consumer affairs to call with inquiries or complaints;
they shall provide all consumers with the certificate of commercial general liability insurance i as well as the telephone number to the issuing company;
They shall include the "Notice to Consumer" required cancellation language in all home-improvement contracts;
they shall not advertise, offer for saleor perform home elevations without being registered as a home elevation contractor ;
they shall not demand final payment before the home improvements or home elevations are completed ;
they shall not to make any misrepresentation of fact in any advertisement, including the company’s website.
The parties have agreed to a settlement of this action in the amount of $250,000. The defendants will pay $200,000 of the settlement. The state agreed to suspend the remaining 50,000 of the settlement which are comprised of civil penalties subject to the conditions set forth in the agreement : for a period of 45 months this suspended payment shall be suspended and automatically vacated provided the defendants shall comply in all material respects with the terms and conditions as set in the Consent Judgment and/or the Defendants do not engage in any acts or practices in violations of the CFA, the Contractor’s Registration Act, The Home Elevation Regulations, the Home Improvement Regulations, and /or the Advertising Regulations.
