On January 20, 2021, a federal grand jury indicted Patricia “Tricia” Ashton Derges, owner of Ozark Valley Medical Clinic, with eight counts of wire fraud, 10 counts of distributing prescription drugs over the Internet without a prescription and two counts of making false statements to federal officers.
Derges sold $191,815 worth of amniotic fluid, which was marketed as a stem cell treatment although the fluid did not contain stem cells. Derges claimed the stem cells could treat various ailments. In April 2020, she posted on Facebook the stem cell treatment could provide a potential cure for COVID-19 patients.
From December 2018 to May 2020, consumers wired money for the treatment to Derges’s bank account.
As a result, Derges must forfeit all property and any proceeds received from the offenses.
On March 26, 2021, Patricia Derges was indicted on three more charges of fraudulently obtaining nearly $297,000 in CARES act funds for reimbursement of COVID-19 tests performed by her for-profit clinic, Ozark Valley Medical Clinic. According to the indictment, Ozark Valley patients had already paid the clinic $517,000 for the tests.
Derges has pleaded not guilty to the new charges at the arraignment on March 26, 2021.
