In November 2019, Better Business Bureau challenged Joplin Bathtub Repair regarding questionable Google reviews. There are Google reviews supposedly from “Homebuild Associated” and “Better Bussiness”. Neither Better Business Bureau nor Home Builders Association post reviews for businesses. Even though the organizations' names are purposely misspelled it has the capacity to mislead. In addition, there were multiple reviews from customers that supposedly submitted reviews for two other companies owned by the same individual.
BBB’s Code of Advertising states, “The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact. In addition, according to the Missouri state statute 15 CSR 60-7.020 (1): “A seller shall not make a representation or statement of fact in an advertisement that is false or has the capacity to mislead prospective purchasers.
In regards to testimonials and endorsements, BBB’s Code of Advertising states, “In general, advertising which uses testimonials or endorsements is likely to mislead or confuse if:
30.1.1 It is not genuine and does not actually represent the current opinion of the endorser;
30.1.5 The endorser has not been a bona fide user of the endorsed product or service at the time when the endorsement was given, where the advertiser represents that the endorser used the product or service.”
BBB asked the business to provide substantiation regarding the legitimacy of the Google reviews and to cease and desist portraying Better Business Bureau as a customer. The company did not respond to BBB’s request.
