Better Business Bureau challenged Handbags & More's advertisement, found in the Southeast Missourian, dated April 3, 2019, that stated, “Total Close Out Everything Must Go!”
The BBB Code of Advertisingstates, “Emergency or distress sales, including but not limited tobankruptcy, liquidation and going-out-of-business sales, must not beadvertised unless the stated or implied reason is a fact; be limited to astated period of time; and offer only such products or services as areaffected by the emergency. Where the advertiser states that it is goingout of business or closing down, it must actually be going out ofbusiness or closing down. Where the advertiser is not going out ofbusiness or closing down, it can advertise that it is ‘selling out’ aproduct or ‘closing out’ particular merchandise, as long as thatadvertiser will no longer carry that product or merchandise. Theunqualified term ‘liquidation sale’ means that the advertiser's entirebusiness is in the process of actually being liquidated prior to actualclosing. If such sales exceed ninety (90) days, advertisers must beprepared to substantiate that the offering is indeed a valid emergencyor distress sale”.
Furthermore,according to the Missouri Attorney General’s Office, any type of salereferencing “going out of business” or “liquidation” should not beadvertised or conducted unless it registered with that office.
BBB asked the business if they had registered its sale with the Missouri Attorney General's Office but our mail was returned and the company did not answer its phone.
