In December 2018, Better Business Bureau challenged Premier Rewards' website. The website stated, “Tired of owning your timeshare? We can get you out of your timeshare in less then 60 days.”
The company's website also stated, “Withus, never pay for another program or maintenance fee ever gain. You’re amember for life. You can even pass the membership on to your lovedones, too. You will have access to all of the programs we offer withouthaving to pay an upgrade fee. You’re also free to cancel at anytime-just send us a friendly notice. There’s no penalty towards you. Ifyou decide to come back it will be free of charge.”
BBB asked the business to substantiate the time frame by which it releases consumers from their timeshares and questioned to what program it is that consumers are obtaining memberships?
According to BBB Code of Advertising, “The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact. In addition, according to the Missouri state statute 15 CSR 60-7.020 (1): “A seller shall not make a representation or statement of fact in an advertisement that is false or has the capacity to mislead prospective purchasers.”
In December 2018, BBB asked the business to provide substantiation that they can get someone out of their timeshare in less than 60 days and to clarify the membership program. The company initially responded but did not provide substantiation to the claims.
