On March 10, 2021, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that Mr. Sewell and the business submitted several applications for real estate licenses and did not disclose that Mr. Sewell had been charged with misdemeanors prior to submitting the applications, a violation of Minn. Stat. 82.81 subd. 12(a)(5) and did not notify the MN Dept. of Commerce that Mr. Sewell has been charged with misdemeanor 'posting signs without a permit', a violation of Minn. Stat. 82.65 subd. 1 (2019). In addition, on 3 of the applications, Mr. Sewell answered in the negative questions asking if he or any businesses he was involved with were involved in any administrative proceedings, when he had been involved in a total of seven previous administrative proceedings, a violation of Minn. Stat. 82.81 subd 12(a)(5) (2019). On all seven applications, Mr. Sewell answered in the negative if any judgements had been found against Mr. Sewell or businesses he was an owner when five judgements between 2008 and 2012 totaling $204,515.93, a violation of Minn. Stat. 82.81 subd 12(a)(5) (2019). The Dept. of Commerce was not notified of the five judgements, as required per Minn. Stat. 82.65 subd 1(2019).  Mr. Sewell did not properly disclose that he had been a defendant in a suit alleging breach of contract, a violation of Minn. Stat. 82.81 subd. 12(a)(5) (2019) and did not properly notify MN Dept. of Commerce that he was a defendant in a civil suit alleging breach of contract, in violation of Minn. Stat. 82.65 subd. 1 (2019).  The agreement further alleges Mr. Sewell and the business, TCREA Lake Minnetonka LLC procured a real estate broker license and a real estate company license by fraud, misrepresentation or deceit, in violation of Minn. Stat. 82.81 subd. 12(a)(6) (2019). 

Under terms of the Consent Order, the business agreed to pay a civil penalty of $7500 (full penalty of $10,000 with $2500 stayed) by April 12, 2021 and $382.50 in investigative costs and to cease and desist from violating any laws, rules or orders related to Minnesota Statute Chapters 45 and 82.
