- Government Actions:Government Action: BBB reports on known government actions involving business’ marketplace conduct:Minnesota Dept. of Labor & Industry Consent Order
On February 2, 2023, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11(b)(2)(5)(8)(9), 326B.809, 326B.84 (2)(4)(5)(14)(15) (2020) and Minn. Rule 2891.0020 (2021). Under terms of the Consent Order, the business agreed to be prohibited from offering anything of value to offset a consumer's insurance deductible or to compensate a consumer for providing any service such as sign credits or referral bonuses and will amend its contracts to include performance guidelines and required warranty, inspections, offers to repair and home warranty dispute resolution information. The business also agreed to have all contracts and change orders be in writing, in compliance with Minn. Stat. 326B.809 and to fulfill all contract obligations and scope of work listed in the contracts with Minnesota consumers as well as ensure all communications with Minnesota property owners and their insurance companies are accurate with documentation to support expenses when requested by property owners and/or their insurance company. The business further agreed to obtain all required permits at or before beginning work in Minnesota and obtain all required inspections and to not seek final payment from Minnesota consumers until the required inspections are passed and all contracted work is complete. The business also agreed to provide itemized invoices for the actual work completed and provide at least 30 days for payment to be made. The business also agreed to cooperate with local permitting authority and comply with State Building Code and manufacturers installation instruction and with DLI's requests for information promptly and accurately. The business agreed to maintain records showing all plans, contracts, documents, records, receipts and disbursements for not less than three years from the date of projects completion and provide reasonable supervision to their employees, agents, subcontractors and salespersons. The business agreed to pay a previously stayed penalty from 2014 and pay $6,000.00 of a $20,000.00 penalty with the balance stayed on the condition that the business engages in no future violations of the laws, rules or orders under DLI authority and complies with the terms of this Order.
