            Federal Trade Commission vs. Staples, Inc.

            The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

            On 1/29/2019 the Federal Trade Commission (FTC) announced it had reached a settlement with Staples, Inc. regarding its merger with another business.  The FTC alleged that Staples competes with the other business to sell office supplies to mid-sized business customers. As a result of the acquisition, Staples would have access to commercially sensitive business information on the other business' reseller customers, and those resellers’ end customers, which could allow Staples to offer higher prices than it otherwise would when bidding against a reseller for an end customer’s business.

            As part of the settlement, Staples will establish a firewall separating Staples’ business-to-business sales operations from the other business' wholesale business.
