On 1/18/2023 & 2/15/2023, BBB reached out to the companyregarding their advertising "Going out of business: EVERYTHING MUST GO,WE'RE SLASHING PRICES !! STORE WIDE UP TO 70%". Per the Code ofAdvertising: To avoid confusion or any possibledeception, an advertiser should consider including a disclosure of boththe minimum and maximum savings available under the offer. In such aninstance, the advertiser must avoid any undue or misleading display ofthe maximum. Where the advertiser states that it is going out ofbusiness or closing down, it must actually be going out of business orclosing down. Where the advertiser is not going out of business orclosing down, it can advertise that it is “selling out” a product or“closing out” particular merchandise, as long as that advertiserwill no longer carry that product or merchandise. If such sales exceedninety (90) days, advertisers must be prepared to substantiate that theoffering is indeed a valid emergency or distress sale.
