On September 3, 2019, the General Court of Justice, Superior Court Division, in Wake County, North Carolina entered a judgment by default against Nicholas Downey and Action Tree Pros. The judgment by default settles charges filed by the North Carolina Attorney General's office that alleged the business and its principal violated a state law prohibiting price gouging during a state of emergency and unfair and deceptive trade practices, following Hurricane Florence. The court's judgment permanently restrains Mr. Downey and Action Tree Pros from engaging in unfair or deceptive actions or practices in violation of North Carolina law; engaging in price gouging in violation of North Carolina law; advertising, offering, soliciting or entering into contracts or receiving payment for any tree or bus trimming or removal services, debris removal or storm related damage recovery or restoration services in North Carolina; performing or providing any tree or bush trimming or removal services, debris removal or storm damage recovery or restoration services in North Carolina; and requesting or receiving payment for any tree or bush trimming or removal services, debris removal, or storm damage recovery or restoration services performed in North Carolina after September 7, 2018. The judgment also orders restitution to consumers in the amount of $2,500 and a civil penalty of $11,000.
