In May2023, Better Business Bureau questioned Agers Heating and Cooling’s website, www.agersheatingcoolingeletrical.com, which stated:
- "100% Guaranteed Satisfaction Delivered Daily"
- "Highest quality products at the lowest possible prices"
- "Our workmanship is backed by a 2-year warranty and a 100% Guaranteed Satisfaction to every type of our customer’s repairs."
According to BBB Code of Advertising, “When using the term“warranty” or “guarantee” in product advertising, the advertiser must clearlyand conspicuously include a statement that the complete details of the warrantycan be seen prior to sale at the advertiser's location, viewed on theadvertiser’s website or, in the case of mail or telephone order sales, madeavailable free on written request. Advertisers should only use“satisfaction guarantee,” “money back guarantee,” “free trial offer,” or similarrepresentations in advertising if the seller or manufacturer refunds the fullpurchase price of the advertised product or service at the consumer'srequest. When “satisfaction guarantee” or similar representations areused in advertising, any material limitations or conditions that apply to theguarantee must be clearly and conspicuously disclosed.”
In addition, BBB Code of Advertisingstates, “Despite an advertiser's best efforts to ascertain competitive prices,the rapidity with which prices fluctuate and the difficulty of determiningprices of all sellers at all times preclude an absolute knowledge of the truthof unqualified underselling/lowest price claims. Advertisers must have propersubstantiation for all claims prior to dissemination. Unqualified undersellingclaims must be avoided. Advertisers can lessen the potential for consumerconfusion by appropriate qualifications to any underselling/lowest price claim,such as by stating, if truthful, that the advertiser will meet or beat a lowerprice.”
BBB asked the business to modify, substantiateor discontinue its advertising claims. The business did not respondand has not modified, substantiated or removed the claims.
