On March 18, 2022, Better Business Bureau contacted Madera Outdoor Co. concerning the following advertising claims found on their website, https://www.maderaoutdoor.com/:
- Going out of business sale
- Environmental claims
- 100% Premium Quality
- Satisfaction Guarantee
- Native advertisement. Evo, Prime, and other seals.
Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided.
Emergency or distress sales, including but not limited to bankruptcy, liquidation and going-out-of-business sales, must not be advertised unless the stated or implied reason is a fact and be limited to a stated period. If such sales exceed ninety (90) days, advertisers must be prepared to substantiate that the offering is indeed a valid emergency or distress sale. If the advertiser is not going out of business or closing, it can advertise that it is “selling out” a product or “closing out” merchandise if that advertiser will no longer carry that product or merchandise.
Claims that relate to tangible qualities and performance values of a product or service can be used when the advertiser has substantiation. An example of a claim requiring substantiation would be "#1 car sales in the city".
Native Advertisements are created to resemble the design, style, and functionality of the media in which they are disseminated, which could make it difficult to distinguish between advertising and non-commercial content.
Despite written requests, as of April 5, 2022, Madera Outdoor Co. has not responded to BBB’s request for revisions and clarification in its advertising.
