BBB files indicate that this business has a pattern of complaints concerning the company's non-disparagement clause in their contract that prohibits customers from filing complaints or posting negative reviews as a result of a marketplace interaction. On October 2, 2024, BBB submitted a written request to the company encouraging them to address the pattern of complaints and remove the non-disparagement clause from their contract. The business responded and did not agree to remove the clause. As of December 20, 2024, BBB continues to see a pattern in complaints regarding this issue and has closed the pattern as unresolved.
As of October 2, 2024 DJW Property Management, Inc’s clause, which is found in its contract, states:
“NON-DISPARAGEMENT: Current Tenant(s) and Past Tenant(s) agree they, their guest, family or acquaintances will not make any statements, written or verbal, or cause or encourage others to make any statements, written or verbal, that defame, disparage or in any way criticize the personal or business reputation, practices, or conduct of Landlord, its employees, directors, and officers. Landlord, Current Tenant(s) and Past Tenant(s) acknowledge and agree that this prohibition extends to statements, written or verbal, made to anyone, including but not limited to, the news media, online review sites, competitors, strategic-partners, vendors, employees (past, present) and clients. All disputes or complaints shall be resolved confidentially, either privately or through the courts. Current Tenant(s) and Past Tenant(s) understand and agree that this Paragraph is a material provision of this Agreement and that any breach of this Paragraph shall be a material breach of this agreement, and Landlord would be irreparably hared by the violation of this provision. Current Tenant(s) and Past Tenant(s) acknowledge they will be assessed an immediate $2000 fee if they, their guest, family or acquaintances violate the Non-Disparagement Agreement, and any fees shall be considered additional rent and failure to pay additional rent upon demand shall be the same default as failure to pay base rent. Past Tenants(s) agrees they, they guest, family or acquaintances will be pursued legally if they violate the Non-Disparagement Agreement. Past Tenant(s) also agrees they, their guest, family, or acquaintances will be pursued legally for the $2000 fee and Past Tenant(s) further understand that if Landlord is involved in any legal proceeding arising from the break of this Non-Disparagement Agreement, then Landlord shall recover reasonable attorney fees, court costs and any cost reasonably necessary to collect a judgement.”
