When using the term “warranty” or “guarantee” in product advertising, the advertiser must clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to sale at the advertiser's location, viewed on the advertiser’s website or, in the case of mail or telephone order sales, made available free on written request.
BBB has received complaints from consumers alleging that they were charged for monthly subscriptions they did not sign up for after purchasing products from Yoga Burn. On March 13, 2019, the business responded that consumers are taken to a page of offers, but never automatically signed up. BBB requested documentation of the offer page to substantiate the claim, and on April 5, 2019, Yoga Burn advised BBB that there is only one “upsell” page and provided a copy to BBB.
On April 5, 2019, BBB secret shopped the business and found that consumers are taken through five “upsell” pages; of the five pages, none were identical to the page that was provided to BBB. BBB found that the first “upsell page” advertised Yoga Burn Monthly as “$0,” when it is actually a subscription that is five payments of $47.00. BBB also found that the option to decline the offer was in very small print.
Any advertisement for a product or service that includes an offer to sell or provide consumers with additional goods or services under a negative option feature must include a clear and conspicuous disclosure of all material terms of the negative option feature. Also, advertisers must not interpret the consumer’s silence, failure to take an affirmative action to reject goods or services, or failure to cancel the agreement, as consent to enroll the consumer in the negative option feature. Instead, they must ensure that the consumer affirmatively consents (either online, over the phone, or in person) to the negative option feature before enrolling the consumer in the plan.
On June 3, 2019, Yoga Burn advised that they had modified their “upsell” pages to remove the zero dollars and that they had enlarged the print. BBB was provided screen shots of the five “upsell” pages. As of June 5, 2019, BBB has not shopped the business to confirm the changes.
BBB also reached out to Yoga Burn regarding the continual advertisement of free items, flash sales and percentage off deals. In review of the business’ web pages, the prices have remained the same regardless of the sale. According to BBB’s Code of Adverting, when comparing a former price to a sale price, the former price must be the actual price at which the advertiser has openly and actively offered the product or service for sale, for a reasonably substantial period of time, in the recent, regular course of business, honestly and in good faith.
In addition, the “free” offer should be temporary; otherwise, consumers may view it as a continuous combination offer, no part of which is free. Thus, where it would otherwise confuse consumers, a product or service must not be advertised with a “free” offer in a trade area for more than six (6) months in any 12-month period. At least thirty (30) days must elapse before another such offer is promoted in the same trade area.
On June 3, 2019, the business advised BBB that they had removed the pricing from the free offers, and also advised that the free product is currently sold out. Upon review, the last free offer post on Yoga Burn’s Facebook page was June 03, 2019. As of June 5, 2019, the product is advertised as “currently sold out.”

On June 3, 2019 Yoga Burn confirmed that they are a subsidiary of Digital Health Solutions Inc which is located and licensed in Barbados.
