On 08/18/2016 Lahaina Carpet & Interiors, Inc (Respondents) entered into a settlement agreement with the State of Hawaii Regulated Industries Complaint Office (RICO), resolving RICO complaint CLB-2011-85-L.
Respondents allegedly failed to provide the required verbal and written homeowner disclosures to homeowners when they entered into a $14,213.45 contract to install flooring in violation of HRS §§ 444-25.5(a)(1), 444-25.5(a)(2), 444-25.5(b)(1), 444-25.5(b)(2) and HAR §§ 16-77-79(a)(4) and 16-77-80(a)(7). Pursuant to HAR § 16-77-71(5), Poseley, as the RME, is responsible for the acts or omissions of Respondent Lahaina Carpet & Interiors.
RICO alleges that in entering aforementioned contract, Respondents failed to explain in detail the lien rights of all parties, explain the homeowner's right to demand bonding, explain how the bond would protect the homeowner, and provide notice of the contractor's right to resolve alleged construction defects prior to commencing any litigation.
The foregoing allegations, if proven at an administrative hearing before the Board, would constitute violations of Hawaii Revised Statutes.
Respondents entered into settlement agreement freely, knowingly, voluntarily and under no coercion or duress; Respondent voluntarily waived it's right to be represented by an attorney.
Respondents do not admit to violating any law or rule but acknowledged that RICO had sufficient cause to file a Petition for Disciplinary Action against Respondent's license. Respondent entered into settlement agreement as a compromise of the claims and to conserve on the expense of proceeding with an administrative hearing on the matter.
Respondent agreed that this settlement agreement is intended to resolve the issues raised in Regulated Industries Complaint Office (RICO) investigation into complaint CLB-2011-85-L. Respondent understands that this settlement agreement is public record pursuant to Hawaii Revised Statutes Chapter 92F.
Respondent agreed to pay a fine in the amount of $10,000.
