If a loan modification company claims to help prevent or defer foreclosures, the following may apply:
- The company cannot request for any payments from clients until all of the contracted services are provided.
- The company needs to supply its clients copies of the contracts, which include clients' right to cancel without penalty until the contracted services are completed, and where to send the cancellation notice.
- The company cannot require clients to sign lien, encumbrance, mortgage, assignment, or deed until full disclosures are given.
