On April 4, 2019, the United States filed a Complaint for Temporary Restraining Order and Preliminary and Permanent Injunction against Regency, Inc., Kelly Wolfe, and other Defendants alleging violations of federal laws (Case # 8:19-cv-00803-VMC-AEP, United States District Court, Middle District of Florida, Tampa Division).
The Defendants and non-party conspirators in this case are: Regency, Inc; Kelly Wolfe; Schuyler Poppe; Michelle Koehlinger; Franz "LJ" Hilberath; Patsy Truglia; Christine Truglia; Joel Rufus French; Lateese Ford; R&L Senior Marketing aka R&L Marketing Group LLC; Aaron Williamsky; Nadia Levit; Star Medical Supply. Other non-party conspirators are: Ever Prime Concepts, Inc.; Charles Burruss; Ardalan "Armani" Adams; SKF Enterprises LLC; Unique Media Connections dba Media Lead Kings; Cure Healthcare Inc.
The U.S. alleges the Defendants have committed and are committing a Federal health care offense by conspiring to violate federal laws in a widespread kickback scheme relying on misrepresentations to Medicare and others. The U.S. alleges that the Defendants conducted in the following:
* conspiracy to commit health care fraud
* health care fraud
* conspiracy to defraud the United States and pay and receive kickbacks in connection with a federal health care benefit program
* making false statements relating to health care matters
* false statements
* violating federal Anti-kickback statute (paying and receiving illegal healthcare kickbacks)
From December 2017 to present, Defendants have dissipated the vast majority of the funds received from Medicare by writing checks and making transfers from corporate accounts in their control to themselves, to other entities they control, and to third parties to pay for real estate, personal luxury items, and other personal expenses. Although Medicare has paid Regency-established DME fronts over $183 million since December 2017, the United States has only been able to locate assets totaling a fraction of that amount.
