As of April 19, 2019, The State of Kansas, 18th Judicial Circuit - Wichita:
ADT LLC, a national provider of home security services, headquartered in Boca Raton, Florida, along with one of its former authorized dealers, EVO Alarm, LLC have entered into a consent judgment with the Office of the District Attorney and agreed to pay $40,000.00 in civil penalties. In 2018, ADT had a contractual relationship with EVO to solicit the sale of security systems to homes in Sedgwick County. The District Attorney's Consumer Protection Division investigated ADT and EVO after a consumer filed a complaint and City of Wichita records showed that both EVO and one of its local representatives, McKay Erickson, were not licensed by the Metropolitan Area Building and Construction Department (MABCD). The District Attorney's Office alleged that the companies' failures to ensure all persons (or authorized dealers) were licensed and had confirmed background checks before entering customers' homes was a violation of the Kansas Consumer Protection Act (KCPA).
In the judgment, ADT agreed not to purchase or service any accounts in Sedgwick County from third parties that have not been properly vetted or licensed. EVO and Erickson agreed they would not sell alarm services or operate without having the appropriate licensure. All three agreed to clearly and conspicuously notify consumers if any personnel entered consumers' homes who did not meet the requirements of the City of Wichita Municipal Code. The companies also agreed that if any other generally regarding this specific issue were raised, the consumers would be provided compensation or relief.
As part of the agreed remedies, ADT provided the District Attorney with the names of customers solicited by EVO/Erickson and the voluntary compensation provided. The original consumer was also provided restitution and there was an assessment of court costs and investigative fees. The companies denied the allegations and ADT denied that EVO and Erickson were legal "agents" of ADT.
The consent judgment was signed by Judge Sean Hatfield on February 13, 2020
