According to the BBB Code of Advertising, claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. For medicinal, therapeutic, and ingredient claims or claims to diagnose, treat, cure, mitigate, or prevent any illness or disease, scientific clinical evidence from human clinical trials is preferred to support these claims. Below is a sample of some of the health benefit and ingredient claims in Elivate MedSpa's advertising.

Its website includes the disclaimer: "INDIVIDUAL RESULTS MAY VARY. THE BENEFITS OF THESE TREATMENTS WILL BE ENHANCED BY ENGAGING IN POSITIVE LIFESTYLE CHANGES SUCH AS EXERCISE, PROPER DIET, AND NUTRITIONAL SUPPLEMENTATION THAT HAS BEEN RECOMMENDED BY THE HEALTHCARE PROVIDER. THESE SERVICES ARE NOT EVALUATED BY THE FDA AND THESE PRODUCTS AND/OR SERVICES ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE OR PREVENT ANY DISEASE." The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. BBB suggested that the statement "INDIVIDUAL RESULTS MAY VARY" should be discontinued or modified to clearly and conspicuously disclose either the typical experience a consumer can reasonably expect or that the results described are not typical. Additionally, in light of the many health benefit claims in its advertising, BBB suggested that the remainder of the disclaimer may create a deceptive contradiction and should be removed unless such claims are modified or discontinued. The business did not respond or make adjustments to its claims.
