According to the BBB Code of Advertising, 'lowest price" and 'top dollar" are claims that can be tested and proven true or false. Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of such price claims. BBB requested that the company discontinue or modify these claims but did not receive a reply.
Under the BBB Code of Advertising, when using the term warranty, an advertiser should clearly and conspicuously include a statement that the complete details can be seen prior to sale. These details should disclose any material limitations on the warranty. In addition, when advertising “lifetime” warranty, the advertisement must clearly and conspicuously disclose its intended meaning of the term “lifetime.” BBB requested that the company clarify its use of the term 'lifetime' and add the terms of the warranty but did not receive a reply.
