- Pending Government Action:Federal Trade Commission vs. QualPay, Inc.
On June 1, 2020, Qualpay, Inc. settled case (No.6:20-cv-00945) brought by the Federal Trade Commission (FTC).
The settlement stems from the complaint alleging that Qualpay Inc., a payment processing company ignored signs that their client MOBE, was allegedly charging consumers hundreds of millions of dollars of worthless business coaching products.
According to the complaint, Qualpay, Inc. failed to review its own internal policies when managing MOBE’s accounts. The company failed to review MOBE's business practices, which should have eliminated them as a client under Qualpay's policies.
According to the settlement, Qualpay, Inc. is prohibited from processing payments for coaching companies or other merchants designated as high-risk, prohibited from making or assisting merchants in making, deceptive statements to consumers or working to avoid fraud or risk monitoring programs, and to engage in screening and monitoring of card-not-present merchants. The settlement also required a monetary judgement of $46,779.91, that has been suspended due to the company's inability to pay.
