In December 2020, Vivint Solar, Inc. (Vivint) entered into a settlement agreement to resolve a lawsuit filed by New Mexico Attorney General's Office in 2018. The original lawsuit claimed Vivint Solar was engaging in unfair and unconscionable business practices including clouding titles to consumers' homes, fraud and racketeering in connection with its residential solar power purchase agreements and solar equipment. The Office of the Attorney General's complaint alleges that Vivint Solar binds New Mexico consumers into 20-year contracts that require consumers to purchase the electricity generated by a solar system placed on their homes at rates that increase by over 72% during the 20 years. The complaint further alleges the Vivint Solar deploys door-to-door sales managers to engage in high pressure sales techniques and procedures designed to mislead consumers into believing that these 20-year contracts will save them substantial amounts of money. The complaint also charges Vivint Solar with filing improper notices in consume real estate records that operate to cloud titles, and in some cases making it difficult for New Mexico consumers to sell their homes.
As part of the settlement agreement, Vivint denied the allegations made by the Attorney General's Office but agreed to modify its marketing practices to provide all prospective customers in the future with clear and understandable explanations about proposed contracts. They also pledged to update its code of ethics to eliminate misleading statements or promises, and to provide ethics training for Vivint sales teams. Vivint agreed to pay $1.95 million payment, including about $709,000 in legal expenses and attorney fees for the law firm that represented the Attorney General.

On October 24th, 2019, New Jersey Attorney General Gurbir S. Grewal and the Division of Consumer Affairs announced that Vivint Solar Developer, LLC has signed a Consent Order and agreed to pay nearly $122,000 and significantly change its business practices to resolve allegations that it engaged in deceptive sales practices, failed to deliver promised energy savings, and otherwise violated consumer protection laws in its sales of home solar energy panels in the state.
Under the terms of the settlement, Vivint has paid the State $121,952.53, of which $69,300 represents civil penalties (with an additional $20,000 of the penalty suspended on the condition that Vivint abides by all the terms of the Consent Order).
